A path to closure aligned with future use

Overview

Hercules began environmental investigation and remediation activities following the cessation of manufacturing operations at the Facility in 1996. Since this time, Hercules has spent more than $50 million investigating and remediating the environmental influences of former manufacturing operations. These efforts began in cooperation with the New Jersey Department of Environmental Protection’s (NJDEP’s) Site Remediation Program (SRP) case team (now known as the NJDEP Contaminated Sites Remediation and Redevelopment Program). In the early 2010s, under the Site Remediation Reform Act (SRRA), Hercules retained a Licensed Site Remediation Professional (LSRP) for the Facility. Remediation work continues under the oversight of the Licensed Site Remediation Professional and in accordance with the Site Remediation Reform Act and associated NJDEP regulations (NJDEP Program Interest No. 000741), with a focus on protecting human health and the environment, returning the land to beneficial uses, and facilitating future public access to portions of the property.

Over the course of the environmental investigation, Hercules has developed a comprehensive understanding of the environmental conditions at the site. A series of reports communicate these findings and guide remediation activities. Environmental testing throughout investigation and remediation has been conducted by independent laboratories certified by the NJDEP. Hercules continues to conduct remediation activities based on prioritizing human health and natural resources; and will continue to perform remedial actions necessary to achieve site closure which satisfies NJDEP laws and regulations.

Hercules has planned for and positioned the property for a return to productive use and future development since initiating remedial activities. The future development of the property has been addressed in the Township of Roxbury’s master plans (and re-examinations thereof) since 1998. Reuse of the site is consistent with the promotion of brownfields remediation and redevelopment noted in the Highlands Water Protection and Planning Act and brownfields-related policies in the Highlands Regional Master Plan. As remediation has progressed, so has interest in development to return economic viability to the property.

Hercules triggers the Industrial Site Recovery Act (ISRA) with the sale of its aerospace division (which includes the explosives and energetics product lines manufactured at Kenvil). In compliance with ISRA, Hercules executes a Remedial Agreement with NJDEP.

1996 - 2005

Hercules conducts Site Investigation (SI) activities and reporting. The Site Investigation provided an initial Facility-wide investigation and assessment of environmental conditions based on more than 2,300 samples. Site Investigation results are summarized in a Site Investigation Report submitted to NJDEP for review, and used to develop the scope of the Remedial Investigation (RI), the next phase of investigation.

Concurrent with SI activities, Hercules completes decommissioning and demolition of 300+ former operational structures and removal of 1,000,000+ square feet of paving and concrete.

NJDEP approves the Site Investigation Report and Hercules moves forward with the Remedial Investigation. 

2005

Hercules conducts the first phase of its Remedial Investigation activities and reporting, collecting more than 2,000 additional samples. Phase I Remedial Investigation work occurs in collaboration with NJDEP using components of NJDEP’s Triad process (systematic investigation based on evaluation of testing results and consensus-based decision making with NJDEP’s case team).  Hercules submits the Phase I Remedial Investigation Report to NJDEP in 2007.

2005 - 2007

Hercules receives NJDEP comments on the Phase I Remedial Investigation Report in November 2010. NJDEP’s comments guide Hercules in developing the scope of the Phase II Remedial Investigation.

2010

Pursuant to the newly enacted Site Remediation Reform Act (SRRA), Hercules retains a Licensed Site Remediation Professional (LSRP) and submits the initial Receptor Evaluation for the Facility.

2010 - 2012

Hercules prepares a Phase II Remedial Investigation Work Plan and conducts Phase II Remedial Investigation activities and reporting with Licensed Site Remediation Professional oversight.

2011 - 2016

Hercules conducts Trinitrotoluene (TNT) Area soil delineation sampling, laboratory tests, and field studies; and selects a remedial approach.

2013 - 2017

Hercules submits an LSRP-certified action work plan with a remedial action work plan for the Trinitrotoluene (TNT) Area to NJDEP and applies for associated permits.

2018 - 2020

Hercules conducts polychlorinated biphenyl (PCB) soil delineation sampling and remedial excavation design; and submits an LSRP-certified remedial action work plans to NJDEP and USEPA and applies for associated permits.

2018 - 2021

Hercules implements PCB soil remedial excavation.

2022 - 2023

2023 - present

Hercules will continue remedial activities sitewide as necessary to satisfy NJDEP site closure requirements. This timeline will be periodically updated to reflect Hercules' continued progress toward closure.
